Public Notice & Opportunity to Comment

I. Proposed Enforcement Actions:

A listing of proposed Assurances of Discontinuance (AODs), Administrative Orders (AOs), and Civil Complaints (CCs) is below.  Select the document title link to review the proposed action and the send comments links to submit a written comment on the proposed action.  Comments received during the 30 day posting period will be evaluated by the environmental enforcement staff.  When warranted, comments can result in modifications to the proposed actions prior to a final order being issued.

II. Final Proposed Enforcement Actions:

A listing of final AODs, AOs, and CCs that completed the 30-day public comment period and have been filed with the Environmental Court is below.  Select the document title link to view a copy of the filed document.  Any person that provided written comments on the document during the 30-day comment period, who is not satisfied with the final action, and who meets the definition of “aggrieved person” as defined in 10 V.S.A. Section 8020(a), may file a motion for permissive intervention pursuant to Vermont Rule of Civil Procedure 24(c) and 10 V.S.A. Section 8020 within 14 days of the filing of the final proposed action.  If a motion is filed, the Court may hold one or more hearings to determine whether to permit intervention or to evaluate the claims within the motion.
Once approved by the Environmental Court AODs become final court orders and are posted on our Assurances of Discontinuance (AODs) page .  AOs and CCs may become final court orders when a hearing is not requested.  If a hearing is requested, the matter proceeds to a court trial.  All final AOs are posted on theAdministrative Orders (AOs) page .  All final CCs are posted on the Civil Complaints  page.

A listing of Emergency Orders (EOs) that have been filed with the Environmental Court is below.  Select the document title link to view a copy of the filed order.  Any person may file a motion for permissive intervention pursuant to Vermont Rule of Civil Procedure 24(c) and 10 V.S.A. Section 8020 within 14 days of the filing of the EO.  A motion to intervene does not stay an EO.  If a motion is filed, the Court may hold one or more hearings to determine whether to permit intervention or to evaluate the claims within the motion.  A respondent may request a hearing on an EO.  If a hearing is requested, the matter proceeds to a court trial.  All final EOs are posted on the Emergency Orders (EOs) page .
